Regulating Foreign Direct Investment (FDI) in India’s Online Gaming Industry

Foreign Direct Investment (FDI) has come out as the main force behind India’s ever increasing gaming industry. With serious market engagement and quick technical advancements, regulatory frameworks seek to evolve themselves on the basis of protection of consumers and security imperatives of the whole nation. By providing a brief overview on the historical evolution of regulatory framework and shedding light on the recent developments, this paper is aimed at tracking the growth of FDI regulation in India’s ever-growing online gaming sector. Besides the already implemented Central and State laws, it discusses the effects of various rules and regulations, including the ones established under different statutes, especially on betting and gambling, improved data privacy and protection, and clarifications of the GST regime.
