Formation of Job Creation Legislation in Indonesia based on Democratisation of Law Making Processes

Abstract

This study aims to discuss the making of work copyright laws in aspects of Indonesian society which are seen as not in accordance with the guidelines of the Indonesian people with the lack of community participation in the creation of the Perpu. The formulation of the problem is taken in writing this time; first, is the drafting of the Job Creation Law in accordance with democratic principles from a human rights perspective in a rule of law country; Second, how is the formation of the Job Creation Law based on the Perpu principle. This research method is normative combined with qualitative research. The results show that the formulation of laws on job creation is procedurally entangled in the process of forming laws and regulations, and encounters many objections from grassroots stakeholders such as workers and other groups. In addition, during the Perpu training on labor copyright law, in its preparation it did not use the Perpu training principles, but in each training there must be legal provisions, these provisions must exist so that later the practical application of the applicable law is formed without conflict. and objections from the parties.
